Binational Marriage as a Way of Acquiring Polish Citizenship

Paulina M. Wojtkowska

Abstract

The phenomenon of binational marriages, including marriages of convenience, is becoming increasingly common in the European Union. It is one of the ways of acquiring Polish citizenship and is a source of privileges for foreigners. The article describes some of these privilages along with negative consequences of attemps to circumvent the law. The author also discusses procedures and formalities which enable foreigners to acquire citizenship or simply legalize their stay in Poland by virtue of being married to a Polish citizen. The article focuses on the possibility of keeping the phenomenon under control through actions undertaken by state agencies and measures designed to facilitate the examination of factual evidence, while respecting the rights of spouses.
