Commercial arbitration during the pandemic

Abstract

The Covid-19 pandemic turned out to be a test for state and arbitration courts. While the operation of state courts was effectively and legally suspended during the first year of the pandemic, exacerbating the already significant backlog of pending cases, arbitration courts functioned without major disruptions, successfully fulfilling their mission of expanding the right to litigate. The article presents achievements of arbitration courts, emphasizing the use of modern IT tools in arbitration proceedings, which can be used to conduct hearings and sessions remotely in the form of videoconferencing. It is, therefore, safe to say that remote arbitration hearings have proved successful. Such positive experiences encourage arbitrators to continue using modern communication technologies even when the pandemic is over.
