Criminal law evaluation of SARS-CoV-2 virus infection

Abstract

The aim of this study is to analyze the possibility of incurring criminal liability for infecting another person with the SARS-CoV-2 virus or endangering someone’s health or life as a result of the infection, and treating such cases as offences with criminal consequences defined in articles 148, 155, 156 and 157 of the Polish Criminal Code. There are also other circumstances that can entail criminal liability. This possibility can, however, be significantly limited if it is difficult to establish a causal link between the behavior of a person suspected of infecting someone else with the SARS-CoV-2 virus and the presence of the virus in that other person and between the fact of that person being infected and certain consequences of such an infection that can be treated as criminal consequences of an offence.
