The Legal Classification of Loot Boxes in Computer Games

Abstract

The article examines the phenomenon of the use of random reward mechanics in video games, commonly referred to as the loot box system. It compares the operational mechanism of loot boxes to the enumerative catalogue of gambling games. The legal classification of loot boxes conducted in the study confirms the proposed research problem, namely that contemporary video games incorporate random reward mechanics that exhibit characteristics of gambling. The analysis is supplemented by the results of an observational study of live-service games, aimed at demonstrating the scale of the phenomenon and corroborating the main research problem. Both legal and non-legal research methods were employed in the article
