Specificity of Trading in Historical Real Estate - Selected Consequences of Registering a Property as a Historical Monument

Paulina M. Wojtkowska

Abstract

The act of registering a property as a historical monument confers certain rights and imposes specific obligations on the owner and organs of public administration, which change their legal situation. The author lists the rights and responsibilities that take effect from the moment of registration and describes the way in which they interfere with and even restrict the ownership of a historical real estate. It can therefore be concluded that the legal consequences resulting from the registration are an important reason why historical real estate transactions account for a relatively small percentage of all property transactions.
