The Impact of the Directive Com (2012) 280 Implementation on the Cooperative Banks Activity in Poland

Anna Szelągowska

Abstract

The aim of this article is to present the influence of the proposal for a DIRECTIVE OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL establishing a framework for the recovery and resolution of credit institutions and investment firms and amending Council Directives 77/91/EEC and 82/891/EC, Directives 2001/24/EC, 2002/47/EC, 2004/25/EC, 2005/56/EC, 2007/36/EC and 2011/35/EC and Regulation (EU) No 1093/2010 on Polish cooperative banks. In case of failures, banks should be wound down in accordance to the normal insolvency procedures. However, the extent of interdependencies between institutions creates the risk of a systemic crisis when problems in one bank can cascade across the system as a whole. Therefore, the mentioned proposal aspires to implement effective tools to manage institutions in crisis and to prevent a domino effect of failing institutions from seriously damaging the real economy.(original abstract)
