Impact of Public-Private Partnership Infrastructure Projects Liabilities on the Local Government Debt

Abstract

Public-Private Partnership (PPP), as a form of cooperation between public and private sectors for the realization of public investment, in the coming years will play an increasingly important role. The article discusses the impact of Public-Private Partnership infrastructure projects liabilities on the local government debt. The main objective of this paper is to discuss, based on the analysis of Polish and Community law, impact of the local PPP infrastructure projects liabilities on the local government debt. In the current legal rules including Public-Private Partnership contracts liabilities to government debt hasn't been adequately regulated. Each case depends on assumptions made for the project, especially the division of risks between the public entity and the private partner. (original abstract)
