Democracy and Supervision as Instruments in Preventing Financial Crises

Abstract

The author argues that financial crises - of local as well as global impact - can be prevented using instruments germane to democratic regimes and legal systems. The sciences of law and politics have identified the fundamental principles on which democratic societies dwell. These principles include: empowerment of the society, accountability of public officials, protection of property, fair employee compensation, transparency of public finance, and preference for nonformal motivation - relying on ethics, morality, common law, customs, beliefs, etc. The primary legal instrument is effective supervision and control in the public finance domain, which should be used to strengthen links between the sovereign and the holders of public offices bearing responsibility for public moneys.(original abstract)
