Privatization of Public Responsibilities through Private Law Entities

Abstract

The problem of declining efficiency in public administration, traceable to the never-ending proliferation of public responsibilities under new or amended laws, has been observed for quite a long time and remains a challenge even today. Despite the wealth of (largely negative) experiences with the privatization of public tasks, accumulated over the past 20 years of socio-economic transformation, we have not been able to address the issue of whether public responsibilities can be lawfully performed by entities governed by private law and, if so, which legal forms should be chosen in delegating such tasks. For this reason, privatization of public responsibilities continues to attract the attention of both administrative and business law experts.(original abstract)
